PURCHASE PROPOSAL
The first step, after finding the perfect home, is to formulate a sales agreement, and pay a deposit to block the property from sale. The seller and the buyer will accept the conditions, both will be obliged to complete the sale, as established in the agreements, and the seller will cash in your check, which will become the corroboratory deposit.
ARBITRATION AGREEMENT
The compromise (also called arbitration agreement) is a deed by which the stakeholders promise to conclude a future contract (deed to the property), and which records and extended all the conditions established in the sales agreement. In the arbitration agreement, the following details must be clearly specified: the personal details of the stakeholders, the property features, its cadastral references, the arranged price, the payment methods and the date of the drafting of the deed, followed by the delivering of the property. Moreover, it must also be stated that the apartment will be sold without gravamen, restrictions or mortgages and fully in accordance with town planning.
DEED TO THE PROPERTY
The deed to the property is the final deed of the sale and it is stipulated in front of the notary, between the stakeholders (seller and buyer).
The notary, in the first place, performs all the checks related to the property subject to sale (cadastral certificates, mortgage documents, etc.), he draws up the deed, which is signed in front of him, and then he realizes the enrollment, paying the relevant taxes, the transcription in conservatorship and cadastral transfer of registration.
Often, together with the deed of sale, the mortgage deed is also signed and, after this operation, the notary shall register a mortgage in favor of the issuing bank. At the time of the deed, the payment of the price is made and the notary expenses are settled.
